    1.1 Introduction:


    OpenEdu (“OpenEdu,” “we,” “us,” “our”) provides its services (described below) to you through its website located at openedu.net, subject to the following Terms of Service (the “Terms of Service”). PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY GOVERN YOUR USE OF THE WEBSITE AND SERVICES, CONTAINING IMPORTANT INFORMATION ABOUT YOUR RIGHTS, LEGAL OBLIGATIONS, AND THE IMPACT ON YOUR RIGHTS IN THE EVENT OF A DISPUTE BETWEEN US.

    To ensure the safety and reliability of our platform and services, we need to establish clear regulations. These terms apply to all your activities on OpenEdu and related services.

    If you create a course on OpenEdu, you must accept SECTION 3 related to Content and Course Materials. This term states that when you upload content to OpenEdu, you grant OpenEdu the right to share that content with learners. The content remains your property, but OpenEdu has the right to review or request the removal of any content that does not comply with OpenEdu's guidelines. You are also responsible for ensuring that your content is accurate, original, and complies with all platform regulations.


    1.2 Modifications to Terms of Service:

    We reserve the right to change or modify the content of these Terms of Service at any time. When changes occur, we will update the new information on this page and indicate the last modified date at the top. We may also notify you through the user interface of the Service, via email, or by other reasonable means, as required by applicable law.

    Changes will take effect ten (10) days from the date of posting, unless related to new features or legal requirements, in which case they will take effect immediately. If you continue to use the Service after changes are made, it means you accept the new Terms.

    2. Access and Use of the Service

    2.1 Your Registration Obligations:


    If you choose to register for the Service, you agree to provide and maintain accurate, complete, and up-to-date information as prompted in the registration form. 


    You must use a valid email address and create a username during this process. The information you provide will be governed by our Privacy Policy. 


    OpenEdu reserves the right to deny service to any user.


    If you are under 13 years old, you cannot use OpenEdu. For those aged 13 to 17, you must have parental or guardian consent to use the Service. By registering for OpenEdu, you affirm that you are capable of understanding these Terms of Service. OpenEdu will not be liable for any damages resulting from non-compliance.


    2.2 Member Account, Password and Security:


    You are not permitted to use someone else's account and must not share your username or password with anyone. Ensure that you maintain control over all devices you use to access the Service. If you do not maintain control, others may access your account and personal information.


    You are fully responsible for any activities that occur under your account and password, and you must ensure that your password remains confidential and secure. You agree to (a) immediately notify OpenEdu of any unauthorized use of your account or password, and (b) ensure that you log out of your account after each session using the Service. OpenEdu will not be liable for any damages resulting from your non-compliance with these provisions.

    3. Content and Courseware

    For Learners: When you enroll in a course on OpenEdu, you will receive lifetime access to the course content. This access is for personal, non-commercial educational purposes only. You may not copy, redistribute, or use the content in any form without written consent from OpenEdu. Any violations will result in the revocation of your access.

    For Creators: When you upload content to OpenEdu, you grant OpenEdu the right to provide that content to learners. The content remains your property, and you may not directly license it to learners without OpenEdu's consent. You are fully responsible for all content you upload and must ensure that it complies with the platform's regulations. OpenEdu reserves the right to review and remove any content that violates our rules or policies.

    For Organizations: Organizations are responsible for reviewing and approving the course content uploaded by instructors within their organization before allowing it to be published. This is to ensure that the content meets the quality standards and regulations of OpenEdu. Organizations must also take necessary measures to verify the accuracy, legality, and appropriateness of the course content, as well as ensure that it effectively serves educational purposes. OpenEdu reserves the right to intervene and request modifications or removal of any content that does not meet these criteria.

    For Writers: When you submit blog content to OpenEdu, you grant OpenEdu the right to share that content with users for educational purposes. The content remains your property; however, OpenEdu has the right to review or request the removal of any content that does not comply with OpenEdu's guidelines. You are responsible for ensuring that your content is accurate, original, and complies with all platform regulations.

    4. Transaction Terms

    To purchase a course on OpenEdu, you are required to complete the payment for that transaction. Please pay attention to the payment details, including the total amount and any applicable discounts. OpenEdu is committed to processing your course purchase transaction accurately and thoroughly. If necessary, payment methods may be updated without prior notice. 

    If you encounter any issues during the payment process or have specific requests related to payment methods, please contact us for assistance.

    5. Promotions & Discount Codes

    5.1. Creators can create promotional codes or discount codes (collectively referred to as "Promo Codes") for their courses. Promo Codes will help reduce the price of Online Content and Subscription Access (including Unlimited and ExpertTracks) on our website. Promo Codes must be applied at checkout and cannot be applied to transactions that have already been completed.

    5.2. Each Promo Code you create will come with its own terms, which will be made clear at the time of issuance.

    5.3. The Promo Code you issue is for personal use only and cannot be transferred to anyone else. If we find that the Promo Code is being misused, not in line with our guidelines, or used fraudulently, we reserve the right to cancel that Promo Code.

    5.4. The Promo Code cannot be transferred, sold, or redeemed for cash or credit, and has no monetary value.

    5.5. The Promo Code is only valid for the time period specified in the terms of use or until the Promo Code has been used, after which it will expire.

    6. Claims of Intellectual Property Violations

    If you believe that your work has been used without your permission and in a manner that infringes your copyright, please provide us with the information necessary for us to review and address your request. The representative for the copyright owner should submit a digital or physical signature along with a clear description of the copyrighted work that you claim is being infringed. You should also provide details about where and how the infringing material appears on our website, with enough information for us to locate it. Please include your contact information, including your address, phone number, and email address. Finally, make a statement that the information you provide is accurate and that this request is being submitted by you as the copyright owner. We take intellectual property rights seriously and will make every effort to review and address your request promptly through our Support Team.

    OpenEdu does not control the content or resources of third-party organizations, but we reserve the right to remove courses if copyright violations or our regulations are detected. If a course is found to be in violation, OpenEdu will take the necessary measures to protect our rights and those of relevant parties.

    Organizations are responsible for ensuring that we are not affected by any actions, claims, demands, costs, liabilities, damages, or other financial burdens incurred by us, arising (directly or indirectly) from:

    8.1. the Organizations managing the Content of the Creators or participating in organizing Online Courses;

    8.2. the access to or use of the Website or the Content and Online Courses by the Creators;

    8.3. the Organizations' violation of any of these Terms (including but not limited to the violation of management obligations regarding Paid Content); and

    8.4. any actions or omissions caused by the Organizations or the Creators, deliberate neglect, or breach of any legal obligations on their part.

    8.5. Each responsibility in this paragraph is separate and independent from the other obligations in these Terms. Each of these responsibilities will remain fully effective despite any indulgence granted from time to time and despite any judgment or order.

    9. Limitation of Liability

    9.1. Your rights under consumer protection laws are not affected by these terms.

    9.2. We provide the Website and Online Content and Courses "as is," without any warranties or representations regarding their accuracy or availability.

    9.3. We accept no liability for any representations, warranties, or conditions, whether expressed or implied by law, custom, or otherwise, to the fullest extent permitted by law. This includes a disclaimer of liability for any indirect, special, incidental, consequential, or economic damages arising from or related to the use of the Website and Content, including:

    9.3.1 Loss of profits (direct or indirect); 9.3.2. Loss of goodwill and reputation; 9.3.3. Loss of opportunity.

    9.4. We strive to provide Content and Courses in good faith, but we do not guarantee that these contents will always be accurate, complete, or suitable for your needs. Your use of Online Content and Courses is entirely at your own risk. Although we have taken necessary precautions to protect the Website from viruses and malware, we accept no responsibility for any incidents arising from this.

    9.8.1. If we suspect you or any Learner associated with you is in breach of these Terms; 9.8.2. To prevent fraudulent or unlawful activities; 9.8.3. To protect ourselves, other Learners, or the public.

    10. Termination

    You agree that OpenEdu, in its sole discretion, may suspend or terminate your account (or any part thereof) or your use of the Services, as well as remove any content within the Services, for any reason or no reason, including, but not limited to, if OpenEdu believes that you have violated these Terms of Use.

    Any activities suspected of being fraudulent, abusive, or illegal may lead to the termination of your access to the Services and may be referred to appropriate law enforcement authorities. OpenEdu also reserves the right, at its sole discretion, to discontinue providing the Services or any part thereof at any time, with or without prior notice.

    You agree that any termination of your access to the Services under any provision of these Terms of Use may be effected without prior notice. You also acknowledge and agree that OpenEdu may immediately deactivate or delete your account along with all related information and files in your account, and/or bar any further access to such files or the Services.

    Furthermore, you agree that OpenEdu will not be liable to you or any third party for any termination of your access to the Services.

    11. Disputes Between Users

    You acknowledge that you are solely responsible for your interactions with other users in connection with the Service, and OpenEdu will not be liable or responsible for any such interactions. OpenEdu reserves the right, but is not obligated, to get involved in any disputes between you and other users of the Service.
